About the course.

More and more construction contracts are carried out as design and build contracts, sometimes in collaboration or partnering. A design and build contract means that the contractor is responsible for both design and execution, and therefore fundamentally has a functional responsibility and responsibility for the works functioning. This course gives you knowledge of the obligations and rights that client and contractor have under a design and build contract.

A design and build contract involves greater risks for the contractor than a construct-only contract and therefore usually a higher cost for the client. At the same time, procuring a design and build contract can give the client a false sense of security, believing that the contractor has a more far-reaching responsibility than ABT 06 states. During this course we go through the rules in ABT 06 that are specific to design and build contracts. The main focus is on the parties' responsibilities at the tender stage. COURSE OBJECTIVES: After the course you should be able to understand what a design and build contract means and when a design and build contract is or is not appropriate. You should understand the system and purpose of the rules on the parties' responsibilities in the design and build contract, how they differ between the tender stage and the contract period, and be able to apply them in situations that arise in your work.

What you will learn

What you learn.

  • What a design and build contract is (compared with a construct-only contract)
  • The rules in ABT 06 that are unique to design and build contracts
  • Different types of design and build contracts, for example managed design and build, procurement on system documents and collaborative contracts
  • The contractor's responsibility at the tender stage: what is included in the contract works, estimating assumptions, the extended duty to investigate in design and build contracts
  • ÄTA work (changes, additions and omissions) in design and build contracts
  • Defect assessment, liability issues and functional responsibility in the design and build contract
  • The contractor's liability for defects
  • Consultant liability under ABK 09, both for consultants procured by the client and by the contractor, and the interaction between the design and build contract and the consultancy agreement
  • Responsibility for the client's and the contractor's technical solutions respectively
  • Responsibility at the tender stage and in the design and execution phase respectively
  • Review and inspection obligations
  • The parties' responsibility for information provided and the assumptions on which the contractor's tender is based (the estimating assumptions)
